Removal of Personal Representative, Executors, Trustees and Agents under Power of Attorney

Occasionally, it may be necessary to remove an individual or corporate entity serving as Personal Representative or Executor of an Estate, as Trustee of a Trust, or as Agent under a Power of Attorney. Removal may be necessary because the individual has died, become incapacitated, because of a difficult relationship between the beneficiaries and the individual or corporate fiduciary, or due to a breach of fiduciary or agency-related duties. Rossway Swan has an Estate Planning and Estate and Trust Administration department in addition to a full-service Civil Litigation department, and the two departments frequently work together to provide comprehensive service to our clients.
